That contact stated that while driving approximately 60 MPH, another vehicle suddenly came in front of the vehicle and depressed the brake pedal, and the braking assist failed to activate. The contact immediately depressed the brake pedal to stop the vehicle. The vehicle came to a stop and avoided a crash. The vehicle had not been taken to the dealer. The dealer was contacted, and an appointment was scheduled; however, the vehicle had not been taken to be diagnosed or repaired. The manufacturer had not been made aware of the failure.
