TL* THE CONTACT OWNS A 2001 BMW X5. THE CONTACT STATED THAT WHILE DRIVING APPROXIMATELY 5 MPH, THE VEHICLE SURGED FORWARD UNTIL CRASHING INTO A HOUSE. THE CONTACT WAS TAKEN TO THE HOSPITAL TO TREAT INJURIES. THE VEHICLE WAS IN THE PROCESS OF BEING TAKEN TO AN AUTHORIZED DEALER TO HAVE THE FAILURE DIAGNOSED. THE CONTACT ALSO STATED THAT THE VEHICLE HAD BEEN EXPERIENCING THE FAILURE ON AN INTERMITTENT BASIS FOR THE PAST TWO YEARS, IN WHICH THE VEHICLE WOULD MOMENTARILY SURGE FORWARD WHILE DRIVING AT VARIOUS SPEEDS. THE MANUFACTURER WAS MADE AWARE OF THE FAILURE. THE FAILURE AND CURRENT MILEAGES WERE 75,000.
TL*THE CONTACT OWNS A 2001 BMW X5. THE CONTACT STATED THAT THE VEHICLE SUDDENLY ACCELERATED WHEN SHE ATTEMPTED TO PARK THE VEHICLE ALTHOUGH HER FOOT WAS ON THE BRAKE PEDAL. SHE ENGAGED THE BRAKE PEDAL CONTINUOUSLY IN ORDER TO STOP THE VEHICLE FROM ACCELERATING. THE VEHICLE WAS NOT INSPECTED OR REPAIRED. THE CONTACT HAD NOT SPOKEN WITH THE MANUFACTURER WHEN THE COMPLAINT WAS FILED. THE CURRENT AND FAILURE MILEAGES WERE APPROXIMATELY 66,500.
